General Terms and Conditions for Competitions and Giveaways

1. Organizer

The organizer of the competitions is marvida GmbH & Co. KG (Siemensstr. 25, 67133 Maxdorf). Further company information can be found in the imprint at www.gelmags.de/policies/legal-notice.

2. Scope and Acceptance

These general terms and conditions of participation apply to all competitions and giveaways conducted by marvida GmbH & Co. KG (e.g., via social media channels such as Instagram, at trade fairs and events, or via its own website). By participating in the respective competition, the participant expressly accepts these conditions.

3. Promotional Period, Prizes and Participation Actions

The specific promotional period (start and closing date), the prize, and the required participation action (e.g., sending a direct message on Instagram, filling out a participation card at a trade fair, or commenting on a post) will be announced directly in the respective call for entries (e.g., in the Instagram post, on trade fair displays, or in the chat).

A change, addition, or exchange of the prize, as well as a cash payment, is excluded. The prize is not transferable.

4. Eligibility

Eligible to participate are natural persons who have reached the age of 18 and reside in a member state of the European Union (EU).

Employees of marvida GmbH & Co. KG and their relatives are excluded from participation.

marvida GmbH & Co. KG reserves the right to exclude persons from participation who gain advantages through manipulation or in violation of these terms and conditions.

5. Winner Determination and Notification

Winners will be determined by random draw after the promotional period has ended, unless otherwise specified in the call for entries.

Winners will be notified via the channel through which they participated (e.g., via direct message on Instagram, by email, or by phone).

If a winner does not respond within 48 hours (or a deadline specified in the respective call for entries) after the prize notification has been sent, the claim to the prize will expire and a new winner will be determined.

6. Cooperations with Partners / Retailer Competitions

If a competition is conducted in cooperation with other companies or retailers, the partner will be named in the respective promotional call. If this is necessary for the processing of the competition or the shipping of the prize, the necessary data (e.g., name and delivery address) will be passed on to the partner. No further use will be made of this data.

7. Release from Instagram / Meta and Third Parties

If competitions are conducted on or via social media platforms (in particular Instagram / Meta Platforms Inc.), the following applies:

The competition is not affiliated with Instagram or Meta and is in no way sponsored, endorsed, or organized by Instagram/Meta.

The recipient of the information provided by the participant and the contact person is exclusively gelmags.

All questions, comments, or complaints about the competition should be directed directly to marvida GmbH & Co. KG.

8. Data Protection

Within the scope of the competition, gelmags processes personal data of the participants (e.g., Instagram username, name, email address, postal address for prize shipping).

Purpose: The data will be used exclusively for the conduct, processing, and prize notification of the respective competition.

Legal Basis: Art. 6 para. 1 lit. b GDPR (fulfillment of contract or implementation of pre-contractual measures).

Deletion: After the complete processing of the competition, the collected participant data will be deleted, unless there are legal retention obligations to the contrary.

9. Early Termination

marvida GmbH & Co. KG reserves the right to terminate or adjust the competition at any time without prior notice if, for legal or factual reasons (e.g., technical malfunctions, manipulations), proper execution can no longer be guaranteed.

10. Final Provisions

The legal process is excluded.

Should individual provisions of these terms and conditions be or become invalid, the validity of the remaining provisions remains unaffected.

The law of the Federal Republic of Germany applies.
